On June 4, 2008, a grand jury indicted Abderrahmane Khellil on two counts of making false statements in violation of 18 U.S.C. § 1001(a)(3). The indictment alleged in Count 1 that on June 4, 2003, Khellil knowingly made false statements in a Form 1485 Application to Register Permanent Residence
