MEMORANDUM DECISION AND ORDER

COGAN, District Judge

Petitioner brings this petition under 28 U.S.C. § 2254, challenging his conviction for second degree murder on two grounds.

First, the Appellate Division held that petitioner's videotaped statement was improperly admitted at trial. It also held, however, that the admission of the videotaped statement was harmless error in light of the other evidence against petitioner,
